People v Lawson, Katie 4-17-0105

SENTENCING The Fourth District determined that the trial court did not abuse its discretion by denying defendant's "extraordinary circumstances" motion for probation after her conviction for aggravated DUI involving a death. Her autoimmune blood disorder could be treated in the prison infirmary where she needed to be housed for her safety, and so her serious medical condition did not rise to the level of an extraordinary circumstance requiring probation, as envisioned by the legislature. The Fourth District also upheld defendant's prison sentence for failure to report an accident involving death.
