VOIR DIRE - Rule 431
Trial court failed to comply with Rule 431(b) since no inquiry regarding defendant's failure to testify. However, this error was waived by the failure to object. The error was also harmless since evidence of guilt overwhelming, there was no indication that the jury was biased, the error was not structural, fundamental, or indispensable to a fair trial, and defendant had refused an instruction regarding his failure to testify. In reaching this decision, the 4th Dist. applied People v. Glasper, 917 N.E.2d 401, and overruled its decision in People v. Blanton, 925 N.E.2d 703.
